FlexiTutor – Terms and Conditions
Effective from: January 2026

These Terms and Conditions form the agreement between you (the parent/guardian/client/student) and FlexiTutor. By booking any session, you confirm that you have read, understood, and agreed to all the terms outlined below.

    1. Booking and Payment
      ● All sessions must be booked and paid for in advance via the FlexiTutor booking platform or an authorised FlexiTutor representative through our email: hello@flexitutor.co.uk
      ● Payment secures the specific time slot for that session.
      ● Prices are fixed at the point of booking and are non-negotiable.
      ● Session credits cannot be transferred, refunded, or exchanged.

    2. Cancellation, Absences, and Refund Policy
      ● FlexiTutor operates a strict no-refund policy. Once a session is booked and paid for, it is non-refundable under any circumstances.
      ● FlexiTutor does not offer rescheduling for missed sessions or sessions cancelled by the client for any reason, including illness, holidays, or last-minute conflicts. This applies to both individual and recurring bookings.
      ● If a FlexiTutor tutor is unable to attend a scheduled session due to illness or an unforeseen emergency, FlexiTutor will offer:
      – A rescheduled session with the same tutor (subject to availability), or
      – A rescheduled session with an alternative tutor of your choice within the same price band as your original session (e.g. Gold, Platinum or Diamond).
      ● Clients are responsible for ensuring availability before booking. Missed sessions will not be credited.

    3. Late Arrival Policy
      ● Sessions will end at the scheduled time regardless of late arrival by the student.
      ● If a student has not joined the session within 15 minutes of the scheduled start time, the tutor reserves the right to leave the session. In such cases, the session will be treated as missed and will not be rescheduled or refunded.
      ● Time lost due to late arrival will not be made up, rescheduled, or refunded.

    4. Communication Policy
      ● All communication regarding lesson planning, progress updates, cancellations, or feedback must be conducted through FlexiTutor only.
      ● Clients agree not to contact any FlexiTutor tutor directly, such as but not limited to: personal phone numbers, messaging apps, email, or social media.
      ● Any breach of this policy may result in immediate termination of services without refund.

    5. Tutor Availability, Continuity, and Substitution
      ● While FlexiTutor aims to maintain continuity, we do not guarantee the ongoing availability of any individual tutor.
      ● FlexiTutor reserves the right to assign a different tutor if necessary within the same price band.
      ● We will inform you in advance where reasonably possible and offer the option to reschedule or select another available tutor.

    6. Student and Parent Conduct and Expectations
      ● Students are expected to attend sessions on time, engage respectfully, and complete any assigned work to the best of their ability.
      ● Disruptive, disrespectful, hostile or inappropriate behaviour may result in session termination without refund.
      ● FlexiTutor reserves the right to refuse future tuition if student conduct becomes unacceptable.

    7. Student Responsibility for Progress
      ● Academic progress and examination results depend on student engagement, attendance, and completion of independent work.
      ● FlexiTutor is not responsible for lack of progress resulting from failure to complete assigned work or follow tutor guidance outside of scheduled sessions.

    8. Parental Authority, Supervision, and Safeguarding
      ● By booking services, the parent or guardian confirms they have legal responsibility for the student and authority to consent to tutoring services on their behalf.
      ● Parents or guardians must ensure a safe and appropriate learning environment, especially during online sessions.
      ● FlexiTutor is committed to safeguarding and child protection. All tutors undergo a DBS (Disclosure and Barring Service) check and are expected to adhere to professional standards at all times.
      ● While we take every reasonable step to vet and monitor tutors, FlexiTutor cannot be held liable for conduct, actions, or incidents that fall outside our reasonable control, including actions taken by tutors or students outside scheduled sessions or private contact not arranged through FlexiTutor.

    9. Recording, Privacy, and Tutor Likeness
      ● Recording, filming, screen capturing, or reproducing any part of a FlexiTutor session is strictly prohibited.
      ● This includes audio, video, screenshots, or any form of reproduction of the session.
      ● Clients may not record, reproduce, distribute, or use the likeness, voice, image, or teaching materials of any FlexiTutor tutor for any purpose without prior written consent.
      ● Breach of this policy may result in termination of services and legal action.

    10. Use of FlexiTutor Resources
      ● All resources, worksheets, presentations, and lesson materials are the intellectual property of FlexiTutor or the individual tutor under agreement with FlexiTutor.
      ● Materials are provided for personal, non-commercial use only by the enrolled student.
      ● You may not copy, share, reproduce, or distribute any materials without express written permission from FlexiTutor.

    11. Non-Solicitation of Tutors
      ● Clients agree not to solicit, employ, or engage any FlexiTutor tutor privately during their engagement with FlexiTutor or for a period of 12 months following their last session.
      ● Any breach of this clause may result in legal action.

    12. Technical Requirements
      ● It is the client’s responsibility to ensure a working internet connection, suitable device, and appropriate platform access.
      ● FlexiTutor is not responsible for missed sessions due to technical issues on the client’s side.
      ● FlexiTutor uses Google Meet for video calls and Google Docs for collaborative work. Other platforms may be used where appropriate.

    13. Force Majeure
      ● FlexiTutor shall not be held liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, power failures, internet outages, platform failures, strikes, government actions, or public health emergencies.
      ● In such circumstances, FlexiTutor reserves the right to reschedule sessions where reasonably possible.

    14. Limitation of Liability
      ● FlexiTutor does not guarantee academic outcomes, exam results, or assessment performance.
      ● Services are supplementary and designed to support learning only.
      ● FlexiTutor is not liable for indirect, incidental, or consequential losses arising from use of our services.

    15. Termination of Services
      FlexiTutor reserves the right to terminate services at its discretion if:
      ● These Terms and Conditions are breached
      ● A tutor or client reports inappropriate conduct
      ● Communication, safeguarding, or conduct policies are violated

      No refund or compensation will be issued where termination results from client breach.

    16. Complaints Procedure
      ● Any complaints must be submitted in writing to hello@flexitutor.co.uk.
      ● Clients agree to allow FlexiTutor reasonable time to investigate and respond before escalating concerns publicly or legally.

    17. Defamation, False Reviews, and Reputational Harm
      ● FlexiTutor does not tolerate false, misleading, malicious, or defamatory statements made about the company, its tutors, or its services, whether online or offline.
      ● This includes, but is not limited to:
      – False or exaggerated reviews
      – Reviews posted with malicious intent
      – Misrepresentation of services, policies, or tutor conduct
      – Public “naming and shaming” of individual tutors
      ● Any review, comment, or statement found to be factually inaccurate, misleading, or damaging to the reputation of FlexiTutor or its tutors may be considered defamatory.
      ● FlexiTutor reserves the right to:
      – Request immediate removal of such content
      – Respond publicly to correct misinformation
      – Terminate services without refund
      – Pursue legal action, including claims for defamation and reputational damage, where appropriate
      ● Clients agree that concerns or complaints must first be raised directly with FlexiTutor through the complaints procedure before being aired publicly.

    18. Respectful Communication and Online Conduct
      ● Defamatory, abusive, misleading, or threatening behaviour towards FlexiTutor, its tutors, or representatives will not be tolerated and will be escalated via legal action.
      ● FlexiTutor reserves the right to terminate services without refund and take further action where necessary.

    19. Governing Law
      ● These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.

    20. Amendments
      FlexiTutor reserves the right to amend these Terms and Conditions at any time. Updates will be published on our website and apply to future bookings.
